1. Purpose of the Service

Clínica Pierde Peso offers a telemedicine service that lets users complete an online medical questionnaire, be assessed by a licensed doctor and, if the doctor considers it clinically appropriate, receive an e-prescription or medical guidance, as well as access a messaging channel with the medical team for treatment follow-up.

The whole Service is provided asynchronously and remotely, under the terms set out in these Terms and in our Privacy Policy.

2. Who can use the Service

• Be 18 years of age or older.
• Reside in Spain or in another European Union Member State where the Service is available.
• Provide truthful, complete and up-to-date information in the medical questionnaire and throughout the process.
• Have the legal capacity to contract health services.

The user is solely responsible for the accuracy of the information provided. Incomplete or inaccurate information may prevent a proper medical assessment.

3. Nature of the Service and its limits

The Service does not replace in-person medical care when this is necessary and is not intended for medical emergencies. The medical team reserves the right not to prescribe, to request additional information, or to refer the user to in-person care or another specialist when it deems this necessary for their safety.

If you are facing a medical emergency or a life-threatening situation, do not use this Service: call your local emergency number or go to the nearest emergency department.

The decision to prescribe, as well as the medication, dosage and duration of treatment, is a clinical decision made exclusively by the licensed doctor reviewing each case, and may differ from what the user requested.

4. Price, payment and subscriptions

The price of each service is shown before completing the questionnaire. Ongoing follow-up treatments are contracted as a recurring (monthly) subscription; one-off consultations are charged once. Payment is processed through an external payment provider (Stripe) and is taken when you submit the questionnaire, before the medical review; if the doctor does not approve the treatment, the amount is refunded.

Subscriptions can be cancelled at any time from the patient area, taking effect at the end of the period already paid for. Cancelling a subscription ends the associated medical follow-up and, where applicable, voids any e-prescriptions linked to it.

In accordance with consumer regulations, the right of withdrawal does not apply once the medical assessment service has been provided and completed with the user's express consent, given its nature as a personalised health service already performed.

5. User obligations

• Provide truthful information about your medical history and state of health.
• Not share your account or login credentials with third parties.
• Use the Service in accordance with the law and these Terms.
• Follow the medical guidance received and raise any questions through the channel provided.

6. Liability

Clínica Pierde Peso is responsible for the medical care provided by its professional team in accordance with accepted medical standards and applicable healthcare regulations. We are not liable for damages arising from misuse of the Service, from false or incomplete information provided by the user, or from force majeure or failures of third-party providers outside our reasonable control.

7. Intellectual property

The content, brand, design and code of the website belong to Clínica Pierde Peso or its licensors and are protected by intellectual property regulations. Reproduction or distribution without prior authorisation is not permitted.

8. Changes

We may update these Terms to reflect legal, technical or Service changes. We will publish the current version on this same page with the date of the last update.

9. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute, the parties submit to the courts that correspond in accordance with consumer protection regulations, without prejudice to any jurisdiction that legally applies to the user.
